Additional permissions and special provisions
Subject to the terms and conditions of CC BY-NC-ND 4.0, the Licensor grants You the following worldwide, royalty-free, non-sublicensable, non-exclusive, irrevocable additional permissions to exercise the Licensed Rights in the Licensed Material. These additional permissions are subject to the prohibited-activities paragraph below. Where an additional permission applies, all other terms and conditions of CC BY-NC-ND 4.0 remain in effect.
- Apply, use and implement methodologies, techniques and processes described in the Licensed Material to manage Your own work or work You otherwise perform for a third party, in a commercial or not-for-profit setting and with or without monetary compensation for that underlying work.
- Create tools, computer systems and software implementing methodologies, techniques and processes described in the Licensed Material in a commercial or not-for-profit setting for own or third-party use, and receive monetary compensation for use of those tools, systems and software from third parties. You may reproduce and Share parts of the Licensed Material only as documentation reasonably necessary to operate those tools, systems and software, provided the attribution requirements are met.
- Use, reproduce and Share the Licensed Material, and produce, reproduce and Share Adapted Material, for Educational Purposes. “Educational Institution” means a school, college, university, or vocational institution recognized or accredited under applicable law, including its teachers, staff, and contractors acting solely on its behalf as part of its ordinary instructional functions. “Student” means a person enrolled in a course or program provided by an Educational Institution.
“Educational Purposes” means learning, teaching, training, research, or development provided to Students as part of an Educational Institution’s ordinary curriculum or recognized program, whether delivered in person or online. A course may teach Clarity directly. Charging tuition or ordinary institutional fees for the broader curriculum or program does not by itself disqualify the use.
Except for Educational Purposes permitted under paragraph 3, the Licensed Material and the Clarity names and marks must not be used, without prior written permission from the Licensor, to create, offer, market, sell, license, or provide any Clarity course, training program, coaching or consulting service whose principal subject or commercial value is Clarity, including a course module incorporated into another course, a course included in a platform or catalog of courses, or a course distributed through a third-party course marketplace. This prohibition also covers any examination, credential, certificate, certification, or accreditation associated with such a course or service, whether delivered online or offline, including in person, and any free offering used to promote a commercial service or obtain commercial advantage. Neither the offering nor its provider may suggest endorsement or imply endorsement, authorization, affiliation, sponsorship, official status, or certification by the Licensor.
To summarize: organizations may use Clarity to manage their own work or work they otherwise perform for clients, and may create commercial tools that implement Clarity. Qualifying Educational Institutions may teach Clarity to enrolled Students as part of their ordinary instructional programs, including online. The prohibited activities described above require prior written permission from the Licensor. The operative terms above and CC BY-NC-ND 4.0 control.
